The company name will be boldly printed several places within the application. The company name must be 30 charaters or less in length. The company slogan (if provided) will be visible, along with the company name, at the top of the application pane. The slogan must be less than 100 characters in length. If the company name is different than the company's website URL, The Ultradatum Company will make every effort to place the URL along-side or below the company name at several points within the application. The website URL should be 50 character or less in length.

The Ultradatum Company may process images prior to incorporating them into the application. Image content cannot be distasteful or obscene. The Ultradatum Company reserves the right to reject images based on size, dimensions and content.

Image dimensions are specified by width x height.

The branded version of the Daily Calorie Needs Calculator is generally intended to be used as a utility on a Health and Nutrition web site, or as a free promotional give-away. The default application images are not properly licensed for a product offered for resale. If you plan to offer your branded software for resale or shareware; you'll need to supply application images that are properly licensed. You'll also need to digitally sign a special online agreement related to the licensing of the supplied images.

Limited software support is provided to the purchaser of the branded software for a period not less than 90-days from date of purchase. Support is not provided to end-users, unless clearly stated in the Ultradatum USER AGREEMENT. Support requests must be emailed to support@ultradatum.com.

The purchase of branded software (also referred to as "Software Application" and "Program") includes a non-exclusive license to use and distribute it for personal and promotional purposes; but, the purchaser must agree to the following terms and conditions:

PURCHASING

[1] The Ultradatum Company (software designer) makes no claims as to the usefulness or accuracy of the information provided in its sales liturature and the information displayed by the Program.

[2] The USER AGREEMENT and DISTRIBUTION AGREEMENT supplied with the branded Software Application, by The Ultradatum Company, must be included with its distribution. Acceptance of these terms and conditions also requires the acceptance of the USER and DISTRIBUTION agreements.

[3] The Ultradatum Company, its employees, its associates, and any distributor of this Software Application, will not be held responsible for loss of data, damage to the computer hardware, or damage to the computer software as a consequence of using this software.

[4] The Ultradatum Company retains full copyright to this Software Application, but the purchaser of a branded version of the Program share with The Ultradatum Company exclusive rights to its distribution. The purchaser of a branded version of the Program may append additional conditions to the original USER and DISTRIBUTION aggrements supplied by The Ultradatum Company, but none of the original conditions can be removed.

[5] The Ultradatum Company reserves the right to make changes to this agreement at any time and without prior notice.

DISTRIBUTION FOR SALE

[1] The Software Application cannot be resold or offered as shareware if it contains any of the default application images.

[2] The Software Application can be resold or offered as shareware if the purchaser of the branded version (a.) supplies all application images and (b.) digitally signs a special online agreement related to image licensing.

SOFTWARE SUPPORT

[1] The Ultradatum Company will provide software support to the purchaser of a branded version of the Software Application for a period of not less than 90 days from date of purchase.

[2] The Ultradatum Company will not provide support to end-users. The purchaser is responsible for providing support to end-users of the purchased branded version the Program.

[3] The Ultradatum Company only provides email support. Support requests must be emailed to: support@ultradatum.com.
